Who is Considered a Contractor?

According to Section 2 of the Construction Industry Development Board Act, a Contractor is defined as:

A person or a firm that carries out construction works in the construction industry, including foreign contractors.

This broad definition encompasses both individuals and companies involved in various types of construction projects.

When Is Registration Mandatory?

Under Section 19 of the Construction Industry Authority Act 2023, no local contractor can legally undertake construction works in Mauritius unless the following two conditions are met:

  1. Registration: The contractor must be registered under the Act.
  2. Permit Compliance: A valid Building and Land Use Permit (BLUP) must be obtained for the construction works, where applicable.

This means that before starting any project, the contractor must ensure compliance with both registration and permitting requirements.

Exemption for Small Projects

Not all construction works require registration. Projects with a contract value of less than Rs 1,000,000 (VAT exclusive) are exempt from registration under the Construction Industry Development Board Act. This exemption supports smaller or less complex construction activities while maintaining oversight on larger projects.

Classification of Contractors

Contractors in Mauritius are classified into six Classes of Works:

  • Building Construction Works
  • Civil Engineering Construction Works
  • Mechanical, Electrical and Plumbing Works (MEP Works)
  • Mechanical Works
  • Electrical Works
  • Specific Works

This classification ensures that contractors are registered and evaluated according to their area of expertise.

Grades of Contractors

Contractors are further categorized into four grades—from Large to Small—based on their capacity and financial strength. Each grade determines the maximum contract value a contractor is legally permitted to undertake. A contractor cannot exceed the contract limit of their grade, helping to ensure that projects are handled by qualified professionals.
